Terms of Use

1. Acceptance of Terms

Welcome to ARCTYPE LIMITED, a company registered in Ireland. By accessing or using our cloud computer platform and AI studio Service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may modify these Terms at any time. We will notify you of changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws
  • If you are using the Service on behalf of an organization, you have authority to bind that organization

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content and Generations

The Service lets you submit prompts, instructions, and files ("Inputs") and produces images, videos, apps, decks, documents, and other output ("Generations").

  • You retain ownership of your Inputs.
  • To the extent permitted by law and the terms of the model providers we use, you own the Generations created for you, and you may use them for any lawful purpose.
  • You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display your Inputs and Generations as needed to operate the Service.
  • Content you choose to publish is visible to other users on Explore; everything else stays private.

You represent and warrant that:

  • You own or have rights to the Inputs you submit
  • Your Inputs and Generations do not violate any third-party rights
  • Your use of the Service complies with these Terms and applicable laws

5. Credits and Billing

Generations consume usage credits, which you can purchase through the Service. You agree that:

  • Purchases are processed securely by Stripe
  • Credit consumption varies by model, workload, and output settings, and is shown per generation
  • Credits are non-transferable and, except as required by law, non-refundable
  • Failed generations may be refunded as credits at our discretion

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, abusive, defamatory, or deceptive
  • Create sexual content involving minors or non-consensual imagery of real people
  • Infringe intellectual property or privacy rights of others
  • Attempt to gain unauthorized access to our systems or other accounts
  • Probe, scan, or circumvent security or rate-limiting measures
  • Use automated means to access the Service without permission
  • Transmit viruses, malware, or harmful code
  • Harvest user information without consent
  • Misrepresent AI-generated output as human-created where disclosure is required by law

7. Third-Party AI Models

ARCTYPE LIMITED is model-agnostic: Generations are produced by third-party AI model providers (for example Alibaba Cloud and Hugging Face), selected per workload. You acknowledge that:

  • Your Inputs are sent to the relevant provider to fulfil each request
  • Provider terms and acceptable-use policies may also apply to your use
  • AI output may be inaccurate, incomplete, or unexpected, and is provided without warranty
  • Similar prompts may produce similar output for other users

8. Intellectual Property

The Service itself — its design, code, and branding — is owned by ARCTYPE LIMITED and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or create derivative works of the Service without express written permission.

9. Copyright Policy

We respect intellectual property rights. If you believe content on our Service infringes your copyright, please send a DMCA notice to hello@arctype.org with:

  • Your contact information
  • Identification of the copyrighted work
  • Identification of the infringing material
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your electronic or physical signature

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and associated data
  • Provisions that should survive termination will remain

You may delete your account at any time through the Service settings.

11. Disclaimer of Warranties

THE SERVICE AND ALL AI-GENERATED OUTPUT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE OR FIT FOR A PARTICULAR PURPOSE.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCTYPE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

13. Indemnification

You agree to indemnify and hold harmless ARCTYPE LIMITED and its officers, directors, employees, and agents from any claims arising from:

  • Your use of the Service
  • Your Inputs and Generations
  • Your violation of these Terms
  • Your violation of any third-party rights

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Ireland.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
